During the European Account Preservation Order proceedings, if the creditor obtains a national attachment order against the same debtor for the same debt, they must:

If the debtor does not comply with the judgment, the creditor can request a mandatory enforcement order from the court, in the form of an attachment order, sale of specific assets, or liquidation of the company.

Moreover, the enforcement of a preventive attachment order is not authorised after the expiry of the time limit provided for in Paragraph 929(2) of the ZPO.

As is apparent from the order for reference, that time limit for enforcement restricts the enforcement of a preventive attachment order, but not its validity.

On 20 February 2017, the Yemeni court confirmed an order to seize the company’s assets.

46.02(1) On a motion for an attaching order, the court may by order (Form 46A),

46.13(1) Where an attaching order has been made and,
