Section 220 provides inter alia that a fine for abuse of process may not exceed ATS 40,000 (paragraph 1).

On 28 March 1995 the District Court issued an order for payment of the fine for abuse of process.

From 1744 to 1756 the Conseil Supérieur refused more than six times to hear his appeals and condemned him some eight times for non-appearance.

Without having held a hearing, it found him guilty of this offence on 5 May 1994 and imposed a fine for abuse of process.

It had also correctly imposed a fine for abuse of process in accordance with section 69 of the Code of Civil Procedure (Zivilprozessordnung).

On 5 May 1994 the District Court, without a hearing, dismissed the applicant's request for legal aid and imposed a fine of ATS 30,000 for abuse of process.
