The Complainant’s right arm was pulled out to the side by SO #2 who then picked up his handcuffs from the ground and placed a handcuff on the Complainant’s right wrist.

The two special constables seemed to pay some extra attention to the Complainant’s right arm.

SO #1 then advanced and took hold of the Complainant’s left wrist/arm, while SO #2 took the Complainant’s right wrist.

In this case, the court concluded that the applicant’s right to procedural fairness had been breached.

Thus it concluded that the grievor's right to procedural fairness had been breached.

At one point, the Complainant walked toward the man at which time WO #3 grabbed the Complainant by the right arm, pulling him away from the man.

The SO then took hold of the Complainant’s right wrist and ordered him to give up his left arm, which the Complainant refused to do.

As such, the Chair found that the complainant’s right against self-incrimination (right to silence) was not violated.

The SO reached out to take hold of the Complainant’s right arm and repeated he was under arrest.

It must acknowledge the complainant s right to know how the complaint was handled.

The Complainant refused and SO #2 grabbed the Complainant’s right arm, stating that he was not in any trouble but that he had to return to the hospital.

SO #2 is then seen to place his left hand on the Complainant’s right arm, whereupon the Complainant then clutches the beer mug with both hands while continuing to walk.

The Complainant shall have five (5) Calendar days within which to correct any such deficiencies, after which the administrative proceeding will be deemed withdrawn without prejudice to submission of a different complaint by Complainant.
