The action is personal to the person entitled to maintenance (see in particular Article 337 of the Civil Code).
Every creditor of support may within six months after the death claim a financial contribution from the succession as support.

The law states that a person who is entitled to receive support may claim a financial contribution towards support within six months after your death, even if he or she did not exercise the right before you died.
Article 53: The maintenance obligation between ascendants and descendants shall be governed by the law of the State in whose territory the maintenance creditor is domiciled.
The person entitled to maintenance submits the application to the transmitting authority, i.e. the Chief Public Prosecutor, using the various forms provided for under Regulation (EC) No 4/2009.
The Maintenance Regulation is intended to enable a maintenance creditor to obtain easily, in one Member State, a decision which will automatically be enforceable in another Member State without further formalities such as registration.
