Drouot, the insurer of the hull of the vessel, had it refloated at its own expense, thereby enabling CMI's cargo to be salvaged.

As the insurer merely of the hull of the vessel, however, Drouot takes the view that it cannot be held liable for the fault of its insured and thus has no interest in the Netherlands action.
